Epstein’s failure to pay the legal tab constitutes “a material breach” of the agreement that allowed Epstein to avoid federal charges and receive a light sentence in Palm Beach Circuit Court, said Steven Marks, a Podhurst attorney. Neither his criminal attorney Jack Goldberger nor his civil attorney Robert Critton returned telephone calls for comment.
The U.S. Attorney’s Office, which negotiated the so-called non-prosecution agreement, declined comment as did State Attorney Michael McAuliffe, whose predecessor agreed to the 2007 deal that allowed Epstein to plead guilty to two prostitution-related charges in state court. He served 13 months of an 18-month sentence during which he was allowed to leave to go to work.
